Terms of Service
These Terms of Service ("Terms") govern your access to and use of GavelScope, a legislative intelligence service operated by Field & Forge Ventures ("GavelScope," "we," "us"), including gavelscope.com and the GavelScope application (the "Services"). Please read them together with our Privacy Policy, which is incorporated by reference.
1. Acceptance
By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" means both you and that organization. If you have signed a subscription agreement or order form with us, that agreement controls where it conflicts with these Terms.
2. Eligibility and accounts
The Services are for professional use by adults. There is no public self-signup; every account is created by an administrator. Keep your password confidential and notify an administrator if you believe your account has been accessed by someone else. You are responsible for activity under your account. You can change your own password from a signed-in session, and an administrator can reset your password or delete your account. Deleting an account removes the login and ends every active session for it immediately.
3. Subscriptions, fees, and payment
Access to paid features is governed by the subscription plan or order form agreed with us, which sets the fees, billing period, and term. Unless your order form says otherwise, fees are stated exclusive of taxes, subscriptions renew for successive periods until cancelled, and fees already paid are non-refundable except where required by law. Where no paid subscription is in place, the Services are provided only for the limited purpose we have agreed with you in writing.
4. License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal government affairs work during your subscription. This right does not include any resale or service-bureau use.
5. Acceptable use and restrictions
Access to AI-scoring and brief-generation functions requires an authorized, signed-in session. You agree not to:
- Access the Services without authorization, or share credentials with unauthorized users.
- Copy, scrape, harvest, or bulk-export data from the Services except through features we provide, or resell or redistribute the Services or their output.
- Reverse engineer, decompile, or attempt to derive the source code or models, or probe or circumvent security.
- Use the Services to violate any law, including any restriction on the use of public records or campaign-finance data, or to send communications that applicable law does not permit.
- Interfere with the operation of the Services or impose an unreasonable load on them.
6. Your content
You own the content you enter into the Services, such as client issue profiles, notes, priorities, and edits ("Customer Content"). You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Services for you. You are responsible for the Customer Content you provide and for having the rights to use it. We do not permit Customer Content to be used to train third-party AI models, and we do not sell it.
7. Our intellectual property
We and our licensors own the Services, including the software, interface, scoring logic, models, and any aggregated or de-identified data derived from operating the Services. Except for the limited right in Section 4, these Terms grant you no rights in our intellectual property.
8. Feedback
If you send us suggestions or feedback, you grant us a perpetual, royalty-free right to use it to improve the Services, without obligation to you.
9. AI output: analysis, not official fact
GavelScope produces AI-generated analysis of public legislative and campaign-finance data. It does not produce official government records, legal advice, or legal conclusions. Bill scores, relevance assessments, summaries, and briefs are generated by a large language model, and the model can be wrong. The citation system is designed to catch unsupported claims but is not a guarantee of accuracy. Any bill status, vote, or filing shown should be verified against the official source before you act on it. The official source for Washington State bill status is app.leg.wa.gov, and for campaign-finance data the Washington State Public Disclosure Commission (pdc.wa.gov).
10. Model estimates
Predictive outputs, such as bill passage probability or sponsor likelihood, are labeled "model estimate" in the application. A model estimate is a probability generated by an AI model from available data. It is not a prediction of outcome, not a professional judgment, and not a substitute for your own assessment. You, not GavelScope, are responsible for anything you send to clients or third parties based on the Services.
11. Third-party services and data
The Services rely on third parties, including Cloudflare (hosting and database), Anthropic (AI processing), the Washington State Legislative Web Services, and the Washington Public Disclosure Commission. Your use of data drawn from these sources may be subject to their terms. We are not responsible for the availability, accuracy, or practices of third-party services.
12. Confidentiality
Each party may receive information the other treats as confidential. The receiving party will use it only to perform under these Terms and will protect it with reasonable care. This does not apply to information that is public, independently developed, or lawfully received from another source without restriction.
13. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FIELD & FORGE VENTURES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT BILL DATA OR AI OUTPUT IS COMPLETE, CURRENT, OR ACCURATE, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FIELD & FORGE VENTURES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
15. Indemnification
You will defend and indemnify Field & Forge Ventures against third-party claims arising from your Customer Content, your use of the Services in violation of these Terms, or your violation of law or the rights of another, to the extent permitted by law.
16. Term and termination
These Terms apply while you use the Services. We may suspend or terminate access for breach of these Terms, non-payment, or risk to the Services or others, and either party may terminate a subscription as its order form provides. On termination, your right to use the Services ends. We will make Customer Content available for export for a reasonable period after termination, after which we may delete it, subject to our Privacy Policy and applicable law.
17. Governing law and disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws rules. Before filing a claim, the parties will try in good faith to resolve it informally by contacting us at the address below. Any dispute not resolved informally will be subject to the venue and dispute-resolution process set out in your subscription agreement, or, absent one, the state and federal courts located in Washington. Any binding-arbitration or class-action-waiver provisions will be added only as confirmed by counsel and presented to you before they take effect.
18. Changes to these Terms
We may update these Terms. If we make a material change, we will post the updated Terms here and, where appropriate, provide additional notice. Continued use of the Services after a change takes effect means you accept the updated Terms.
19. General
These Terms, together with any subscription agreement and the Privacy Policy, are the entire agreement between you and us regarding the Services. You may not assign them without our consent; we may assign them in connection with a merger or sale of the business. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control. Notices to us should go to the contact below.
